End User License Agreement

Introduction

This End User License Agreement ("EULA") is a legal agreement between you and QRsafer ("we," "our," or "us") governing your use of our QR code security scanning application ("App").

By downloading, installing, or using our App, you agree to be bound by the terms of this EULA. If you do not agree to these terms, you must not download, install, or use the App.

License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control for your personal, non-commercial use.

This license does not allow you to:

• Modify, alter, adapt, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Copy or reproduce the App or any part of it
• Remove, alter, or obscure any proprietary notice or label on the App

Ownership

The App is licensed, not sold, to you. We retain all rights, title, and interest in and to the App, including all intellectual property rights. All trademarks, service marks, trade names, and trade dress that may appear in the App are the property of their respective owners.

App Store Terms

This EULA is between you and QRsafer only, not with Apple Inc. ("Apple") or Google LLC ("Google"). We, not Apple or Google, are solely responsible for the App and its content.

For Apple App Store Users:

• You acknowledge that Apple has no obligation to furnish any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

For Google Play Store Users:

• You acknowledge that Google has no obligation to provide support services for the App.
• To the extent required by applicable law, additional Android App Distribution terms may apply.

Privacy

Our Privacy Policy, available at qrsafer.com/privacy-policy, describes how we collect, use, and share your personal information. By using the App, you agree to our collection, use, and sharing of your information as described in our Privacy Policy.

Subscription Terms

Free Version

• The free version of our App provides basic QR code security scanning using industry-standard security services
• The free version includes advertisements with 30-second delays
• Scan history is limited to the last 20 scans
• Certain features are limited or unavailable in the free version

Premium Version

• The premium version provides comprehensive QR code security scanning using multiple advanced security services
• Enhanced threat detection through various specialized security providers
• The premium version is ad-free with instant results
• Unlimited scan history and file detection capabilities
• URL expansion and redirect chain analysis for shortened links
• Additional features are available in the premium version
• Pricing for premium subscriptions is subject to change based on market conditions

Payment and Billing

• Payment for premium subscriptions is processed through Apple's StoreKit (for iOS users) or Google Play Billing (for Android users)
• By subscribing to our premium service, you authorize the applicable payment system to charge your payment method for the subscription fee
• All fees are exclusive of taxes, which may be added to the subscription fee

Subscription Period and Renewal

• Subscriptions are available on a monthly or annual basis
• Your subscription will automatically renew at the end of each subscription period unless you cancel it before the renewal date
• The renewal charge will be the same as the original subscription fee unless we notify you of a price change

Cancellation and Refunds

• You may cancel your subscription at any time through your device settings, App Store account settings, Google Play account settings, or by contacting us
• If you cancel, you may continue to use the premium features until the end of your current subscription period
• We do not provide refunds for partial subscription periods unless required by applicable law or platform policies

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL FUNCTION UNINTERRUPTED, SECURELY, OR WITHOUT ERROR, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APP, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (i) your use of the App; (ii) your violation of this EULA; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

Term and Termination

This EULA is effective until terminated by you or us. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. You may terminate this EULA by deleting the App and all copies from your devices.

We may, in our sole discretion, terminate this EULA at any time for any reason. Upon termination, you must cease all use of the App and delete all copies.

Export Regulations

The App may be subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree to comply with all such laws and regulations and acknowledge that you have the responsibility to obtain such licenses to export, re-export, or import as may be required.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any legal action or proceeding relating to this EULA shall be brought exclusively in the federal or state courts located in San Francisco, California, and you hereby consent to such jurisdiction.

Severability

If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Amendments

We reserve the right to amend this EULA at any time by posting the amended EULA on our website or within the App. Your continued use of the App following such amendment constitutes your acceptance of the amended EULA.
